First of all, Tortuguita was personally a pacifist in regards to the question of violence, and it's on the record through interviews done with them before the shooting, as well as people who personally knew them.
The gun shown is a gun specifically marketed towards police and is carried by officers primarily (S&W 9 Shield). I'm quite confident this was a drop gun.
I think the story is that a cop accidentally shot at another in a overzealous friendly fire incident, and to cover it up, they fired at Tortuguita and dropped a gun on them.
There has also been no body-cam footage to be released, as of yet.
