Yet federal prosecutor Michael Longyear wrote that prosecutors are agreeing to drop count 2 of the indictment — possessing a machine gun in furtherance of a racketeering conspiracy.
“The Government will move to dismiss Count Two at sentencing,” said Longyear. “Thus …the defendant’s mandatory minimum term of incarceration would be 37 years’ imprisonment.”
While the 23-year-old faces a mandatory prison term under federal sentencing guidelines, his cooperation with prosecutors against various members of the Nine Trey Gansgta Bloods opens the door for judge Paul Engelmayer to impose a sentence below the guidelines range — meaning Tekashi could get as little as time served.
Prosecutors have described the controversial entertainer’s cooperation as “extraordinary.”
He’s scheduled for sentencing on Dec. 18.

The Brooklyn, New York rapper was charged with one count of racketeering and 8 other charges for his role in a crime wave throughout New York City from 2017-2018 with members of the Nine Trey Gangsta Bloods.
The rap star, born Daniel Hernandez, decided to cooperate with the Feds immediately after he was arrested on November 18th, 2018.
Tekashi 6ix9ine, who was facing 47 years in prison, turned state's evidence and provided valuable information to the government, which led to the convictions of a dozen members of the Nine Trey Gangsta Bloods.
Earlier today (December 12th), Judge Paul Englemayer said he received a letter from Tekashi 6ix9ine, who is objecting to one possible aspect of the Probation Department's guideline calculation.
"On its review of the parties' sentencing submissions, the Court notes that defendant Hernandez objects to one aspect of the Probation Department's guideline calculation, relating to his criminal history," said Judge Paul Englemayer.
The rapper does not want his prior criminal history to influence his sentence when it is handed down on Wednesday.
Judge Engelmayer has ordered Federal prosecutors to submit a letter to clarify "whether it has any objections to the Probation Department's guidelines calculation, and specifically to set out its position on the criminal history objection raised by the defense."
There's still a chance to Tekashi 6ix9ine could be sent to prison but it appears the Feds are leaning towards granting the rap star his freedom.
While he didn't request a specific amount of time, lead prosecutor Geoffrey S. Berman submitted a glowing recommendation letter to Judge Englemayer, praising Tekashi 6ix9ine for his cooperation during the year-long investigation.
Yesterday, Tekashi wrote a letter to Judge Englemayer begging him for mercy when he is sentenced on December 18th.
