The constitutional standard is “plausible” facts. Essentially, you have to show the court that is it more than possible and reasonable to believe you have claim.
Reading the NY Bots & Payola document, Drake’s firm is requesting the identities of the unidentified actors who were used to promote NLU. One of them was Akademiks guest, whose veracity of his claims was even questioned by Ak on the stream. So the firm is using NFR retweets and Akademiks guest to dig around UMG and find something that shows a payola scheme. If they don’t find these transactions, can’t verify that UMG paid influencers, or find UMG’s bots, the firm might advise Drake they can’t meet the standard to file a claim.
I haven’t read defamation filing, but I’d imagine the biggest obstacle for the Drake suing is showing that NLU is actually false. That’s a high burden, because UMG’s counsel could cut through his argument pointing out the nuisances of NLU (ie, he doesn’t explicitly call Drake a pedophile, he says that he is harboring pedofiles and likes them young). Drake would need to prove that he hasn’t done any what NLU alleges as a matter of fact before even getting to the distribution issue. Part of the reason Cardi B got a rare defamation win against a YouTuber who said she has STIs was because she proved to the court through medical records she did not have STIs.
Also, there is a tougher first amendment standard for public figures to meet that they were defamed, which is to protect the public from being sued. Law has said that public figures with big platforms can counter damaging speech with simply more speech on their part. Drake went back and forth in a rap battle, said possible defaming statements in family matters and released the Heart Part 6. I can see the courts finding his own speech as enough to remedy Kendrick’s allegations and refrain from ordering a remedy from UMG. Judges hate getting into music disputes and do not want to disturb businesses activity, for economic reasons.
