Kenneth "Lil Woody" Copeland is expected to testify today, however, the state informed Judge Glanville that Copeland appears to have secured an attorney and asked that all communication with Copeland be stopped.
ADA Hylton did tell Glanville that the state offered Copeland immunity for his testimony, so his testimony can't be used against him.
Copeland's lawyer is up in another courtroom, so Glanville sent someone to get him to discuss Copeland testifying today.
Copeland's attorney said the state knew about him representing Copeland since the case began, even naming Don Geary, who was the former prosecutor in the case.
Copeland's attorney said Copeland plans to exercise his Fifth Amendment right against self-incrimination.
"He does not wish to testify in this trial," Copeland's attorney told Glanville.
He asks that Copeland be allowed to leave the courtroom.
ADA Hylton told Glanville that they've spoken to Copeland multiple times and he never asked for his attorney to be present.
Hylton and other attorneys received an email last night stating that Copeland was planning the plead the Fifth Amendment.
