He got arrested on a Saturday and the official arraignment happens on Monday regardless. I don't think a prosecution would have had any chance to see evidence or drop a charge yet. Simply having a preliminary hearing isn't an indication of how strong a case is, that's where we learn how strong the case might be
Also Majors team seems to be wanting to use the video and taxi driver as their evidence. The witness recanting was just a part of what they said they were going to present
