yeah I was wondering if you're consistent with it. my opinion for both cases is unless they got into a specific contract (even then likely due to lack of experience) they absolutely should get publishing. it doesn't matter who wrote it; Prince obviously had Nothing Compares 2 U as a sketch and it became the most throwaway track ever that he gave to his backing band lmao. but regardless of quality it shouldn't even matter whether they did a good job with someone else's material; any artist should get compensated for how they interpret something. you mentioned some Ariana Grande song that had like 3 different artist running through it and it was obvious it wasn't getting anywhere. even with all these names attached to it they didnt do s*** with that. Ariana Grande made it a chart-topping single, and im absolutely sure she paid up to whoever did the song originally, as she should, but there's no way she doesn't own publishing rights to it

They're wrong for finessing her, but in situations like this...where the lawyer at to go over these contracts? Never do handshake agreements when money is involved. Get it in writing and go over it thoroughly.

Yes actually lol working in the TV/Film industry currently I'm learning that young actors, independent musicians, etc are actually capable of reaching out to lawyers to go over their contracts and hire them when they're starting out. The lawyers and managers just end up taking a slightly higher percentage, which makes sense because as the person is just starting out.

Most times they don't though because they're only thinking about the money for the short term instead of thinking further down the road when they will (hopefully) be making more money. It's better to give up a higher percentage to legal representation for your first deal, than try to represent yourself and end up getting screwed over and getting nothing.

If you have no money, how are you going to hire a lawyer? If you dont have anyone to tell you about contracts, you’re poor and have just been offered life changing money, you will likely accept it. These are always coercive conditions. idk why you’re trying to justify f***ed up contracts… I’m not going to blame someone who doesn’t know something for making a mistake, especially when they didn’t have money and want their dreams to come true. I know how the system works and its unfair exploitation especially for (young) musicians who have no union (for the most part).

If someone really wants to work with you, and THEY have the means of getting a lawyer to make a deal official, tell them to get to it, or walk away.

I think you're misunderstanding something. I never said anywhere in this post whether screenwriters make royalties at all (and they do sometimes, according to my research, but it's a contract by contract basis, so you're wrong if you're implying they just never do). I was just presenting an example to lend credence to the idea that people (actors in this case) shouldn't make royalties off of something they had no involvement in, namely the script. Also actors don't always make residuals, as again it's a contract by contract basis.

Really in hindsight I didn't need to use an example at all, but that doesn't mean the example I used was necessarily bad or wrong. In a perfect world screenwriters would always be making publishing royalties off the things they write just like any other writer should in any other medium. Just because these are "two different industries" doesn't mean they have "no correlation", that is abjectly false. Also to imply that the writer's strikes were solely caused by royalty practices in the industry is extremely reductive, the strikes were brought about by a variety of factors.
