His deal is a publishing deal, so it's an advance that doesn't get paid back. In exchange, he has to deliver x number of albums in x years published by Universal, as well as provide rights to various aspects of his likeness. We don't know the real details of his deal to be fair, it's all speculation, but no, it wouldn't have to be paid back.
What would be more likely is that if he were to be arrested and locked up, he would fail to meet the x number of albums because he'd be in prison, and then he'd be sued by Universal.
Money would only go to victims if the victims sued Drake, it has nothing to do with Universal, his music, anything, and no, no one would get refunds for anything because that has nothing to do with it.

Cole ducking out the beef was an L for him in the short term, but he will be OK in the longterm I think. I think most people understand why he dropped out at this point.
