I think its was partly by design at the beginning but then it went off the rails but its somehow still aligned with his plan.

Honestly AWT being Act 3 makes so much sense and fits in with the original plan, I think he should just go along with it and rename AWT to Act 3: A Written Testimony.

Also wasnt the original title of Act 3 The Last Will and Testament of Elpardo Flowers? Its a similar name to AWT

If it was never meant to be Act 3 then I wonder if Jay will make it. Now that hes officially released Act 2 he kind of has to finish the whole thing with Act 3 (even though this could be AWT now)
