Yes you could prove he intended to seriously harm or kill the victim (2nd degree)

OR that he was extremely reckless and negligent (3rd degree) without the actual intent to intent to kill the victim.

The former is not quite easy to do, whereas no one can make an argument against the latter.

I'm all for charging him with second degree murder but we all know how that would unfold. I think the prosecutor did the smart thing here
