it's a tonic minor chord, the 7th is just a non chord tone, bach usually used them just as finale chords, to add some color/dissonance, it's more of a jazz chord

if you're using it just as a singular chord in a whole piece u use the melodic minor scale

u could use it as a substitute for the IV chord in a major cadence too, the plagal cadence
