    It's funny too because after Drake's case came out people on socials were saying, "it wasn't botted! I heard this song everywhere!" Yeah it's because UMG made sure you heard it everywhere to deny the bot claim. UMG tried to make this seem organic.

    Don't think it would be a per se case because when it involves a public figure the action must be done with actual malice which is a higher standard "meaning they knew it was false or were recklessly disregardful of its truth".. per se is an easier standard.. here the suit is against UMG not Kendrick so proving UMG didn't know it was true is more difficult (they will immediately bring up that concert video) cuz they can weasel out of it. They want the rico more than the defamation tbh.

    Ehhh its not really the fact that im saying any of that s*** is ironclad it's the avenue that's most susceptible to a loss.. when your plaintiffs side you throw s*** up on a dartboard but you always save the best best dart for last.. defamation as they said they have enough to file but want to see if they can file rico.. why? Easier to convict on a Rico. Every point your saying is absolutely a fair counterpoint but then there's rumor this innuendo that right?.. the point is you don't want ANY debate with that malice forethought standard.. the standard was defined because, in the eyes of our legal system, public figures open themselves up to publicity and the gossip rumors innuendo etc that goes with that.. so technically it's a freedom of speech catch all to make it easier for ppl to publish s*** about public figures without fearing a defamation suit.. ie this very situation.. that's not to say it hasn't arisen or can't be won but the standard is defined for this moment.. so again if you have a situation where there's any debate the court could per chance rule against you.. you don't want chances if your plaintiffs side right? You want a home run hit like a rico.. so again main point is just it's not defamation per se it's a malic aforethought standard which is a very high standard and designed for this situation by its very nature, just how we learned it in entertainment law
