The free refills and serving cold are the most dangerous part. The bitter flavor and hotness of coffee prevents people from downing the whole thing in a few gulps for a slower intake of caffeine which makes it last longer and isn't as hard on the body. But serving a beverage with that much caffeine, cold, on top of an unknowing customer getting back to back refills is a recipe for disaster.

Caffeine is a vasoconstrictor which causes your blood vessels to temporarily become narrow in addition to increasing your heart rate
If you take too much caffeine and already have a heart issue whether diagnosed or not, it can play a role in a heart attack
It will probably not be easy to prove who’s at fault, but since Panera has already given out a settlement payment, I’m sure they don’t want a drawn out public court case just to gamble on the outcome
