I think that most rapist don't go to jail because it's hard to prove for some.
It might be that most rape cases aren't the violent rapes with lots of physical evidence. The legal system is also preferable to cases with strong arguments that have a higher probability to be won.

Intent, which is a thing in criminal law. Next question is how do you prove intent. Every jurisdiction has different ways and different degrees of intent.
