Sure, but it didn't backfire because he asked for her consent. It would've backfired even if he just went for the kiss without asking. I think asking for her consent is better than not asking. Overall, the two of them messed up in this situation. OP was unprofessional for doing this at work, and the girl was misleading/tricking him if she gave him the OK to kiss her, only to report him to HR right after.

I had that possibility in mind as well (the fact that she may have said yes out of fear), I just didn't care enough to unpack all the possible scenarios and follow-up questions to each scenario in my post but I definitely get it and I agree with you.
