In court they said she was shot while walking away and shot while exiting the vehicle (so half in car and half outside).
Also the location of the actual shooting is up for debate as they weren’t pulled over at the shooting location and have not revealed the location of the shooting.

To be clear shrapnel is bullet fragments broken from the impact of a bullet hitting a surface. That doesn’t mean you were directly shot it means you were hit by shrapnel.

This aligns with the story of him allegedly shooting the ground.

He could be charged with reckless use of a firearm but aggravated assault might be a reach he could argue it was an accidental discharge and the sharpnel is just an accident based on where she was standing when the bullet hit the ground.
