I think we could look at real life as a good example. When you commit a crime there's different levels (first degree, second degree, etc) and different punishments for each. It's not black and white and neither should the internet. Blanket bans don't address the issues they just censor them without anyone learning or understanding from them. With that in mind I don't think it's applying rules selectively at all. A human should review the case and judge instead of an AI or automatic system.
