It can be bad. A lot of comedy is just unfunny. A premise as lazy as offending people outlived its novelty like 5 years ago at least. Maybe I just grew up. Shockjock humor just went out with the original South Park and Eminem and whatever else.
Chappelle is a great example of how the angle is important. In one of his first Netflix specials he has a joke about trans people where the premise is just sticking their nuts on a table. Kinda boring. Lazy. Then in his new one he has an LGBTQ joke that is really well thought out and clever. The extended road trip metaphor. Now I'm sure some people found both offensive. I think the latter was actually really funny.
I don't think any subjects are off limits. It's the approach that makes or breaks the joke.

But should we make that illegal? No, everyone should be entitled to say and joke about whatever they want, but they also have to man up to the consequences their actions might have.

I’m pretty sure he and Neal Brennan had full creative control. The way he always describes it, it seems like he walked away because of stress/pressure and mental health reasons. He reached the top of his profession from a business standpoint, but was unhappy and unfulfilled.
If the shock value feels tryhard and takes away from the joke, it absolutely can go too far.

There's a line between making fun of a group of people and using "comedy" as a form of hateful rhetoric towards them. I think obvious cases of the latter shouldn't be protected as free speech, and it's mostly closeted bigots who think the grey area between the two is funny.
