And even if the magazine was free, it was part of promotion for a paid work (the album.) that’s why there’s a highlighted passage of “I hope they talk about the album”

Nah you can make money off of parody. The issue is whether or not the use of Vogue WAS a parody by drake

Under U.S. Copyright Law, a parody can be considered a “derivative” work protected from copyright infringement claims by the fair use doctrine.
Vogue is probably claiming this Drake’s use of their trademark is not a parody relative to the announcement and distribution of the magazine
