The case law the state provided was on point and has convinced the Judge that Woody's interviews are largely admissible, but because they are striking a lot of his testimony, they will only be admissible if he testifies in a similar way again.

The Judge shifts her attention to the redactions already done by Judge Glanville for a lot of the 16 hours of Woody interviews, and asks if they need to revisit any of them.

State says it has no objections to any of Glanville's redactions.

Schardt says that his position is now that they were dealing with a biased Judge, so they now (for the record) object to many of his rulings, not only the ones from after the recusal motion

Judge makes it clear she's only revisiting rulings from after the recusal motion.

Judge not happy that the defense was not prepared to revisit the Glanville redactions today. She says they may need to have a "long night" tonight to prepare for tomorrow.

In the meantime today they are moving forward to potential issues with statements from the other witnesses

To introduce a "co-conspirator statement", the State must give advance notice of the statement. In their notice in November 2023, the State only gave notice of THREE co-conspirator statements.

Bruce Harvey strongly objects to any statements other than those 3 coming in.

if you're on the jury for this long what is the compensation like?

  • Jul 31, 2024

Judge Whitaker says this "trial by ambush" should not be happening.

She has already required the State to provide SPECIFICALLY what evidence they will introduce through each witness (something Glanville refused to do).

She now wants the State to provide all "co-conspirator statements" immediately so she can litigate which are admissible and which aren't. There will be more argument regarding this.

Payment amount varies by county and is between $5 and $50 per day

Fulton County pays $25.00 per day

is being forced to go to jury a reason an employer can fire you?

No that's illegal. An employer can't fire you just because of that.

Employees are generally protected when they take leave for jury duty

The only thing is the juror may not get compensated their full salary

Alot of the people doing jury duty in this case are retired and unemployed, which is one of the reasons why jury selection for this trial took so long

Brian Steel's is trying to bring his motion to dismiss / plea in bar / general demurrer from months ago

In that motion, Steel claims the indictment is missing language REQUIRED to charge someone with RICO. He compares it to the Donald Trump RICO, which he says is "correctly" written and says the prosecution dropped the ball.

  • Jul 31, 2024

(If this is granted, it would end the trial)

  • Jul 31, 2024

Judge Whitaker is listening to Steel re-argue it right now but it's unclear if she actually will reconsider Glanville's ruling or give a certificate of review.

Jury is finally back after almost 2 months.

Woody back on the stand today with the choice to testify or go back to jail.

  • Aug 12, 2024

After a long back and forth with the Judge, telling her that he was pressured, and seemingly giving it a lot of thought,

Woody has indicated that he will testify.
