If someone is explicity threatening your life, going as far as to say they dont care if they go to jail for it, doesnt justify physical intervention, what does? When youre with your sister or mother and someone is yelling in your face that they dont care if they to jail for killing you, are supposed to calculate in your head how mentally ill this person is and just what? Run away? On the subway? Neely did not deserve to die but Penny was obviously defending himself.

Like are we just supposed to go "oh that was a threat from a homeless person, be noble and ignore it".

The objective of Penny's trial wasnt to figure out how to address the homelessness epidemic. Its a real problem and in a just society Neely have never been beaten down to such a tragic mental state. The objective of Penny's trial was to determine whether or not he was defending himself and the other passengers, and the jury made the right decision.
