So I’m a target inbound (I unload thousands of boxes from trucks) worker and there’s a crazy manger named Erica who has decided to be a nuisance to me. She has

    • hit me with a railing, which injured my arm and caused me to lift with my chest. Consequently, I have permanent chest pain. It feels like my chest is being pulled apart.

    • thrown my work on the floor. After I reported her to HR, she walked up to me and threw all of my work on the floor and walked away.

    • hit me with boxes. For example she’ll be grabbing a large box near me and allow the box to brush against my arm. She knows im in a close vicinity to her and doesn’t care.

    • told me to “move” out her way.

    • falsely accused me of not calling out properly (despite my phone records proving otherwise).

    • After I rerouted her for abuse, Target still made me work closely with her which enabled her to retaliate.

    • I also have a pre-existing medical condition that was injured due from her attacks.

I reported her to HR but they told me that she hasn’t done anything to warrant a response. I have dates, times, and incident reports of all her actions. Additionally, for the last two weeks I’ve been working with work restrictions but I am still in pain. People keep telling me I have a strong case to sue but I don’t know how. I have called employment attorneys and personal injury attorneys and they haven’t been any help.

Do I have a case? Because I am hitting a dead end. I have been calling attorneys for the last two weeks and I’m starting to give up.

Hard to prove injuries that aren't reported immediately, sadly. Being rude by telling you to move isn't anything and hitting you with boxes wouldn't hold up in court against their lawyers either, she could say it was by accident. Throwing your work on the ground could definitely be considered intimidation though, stuff like that you should keep reporting to HR.

Does she do it to anyone else? Would boost your case a lot if someone else reported her too

Thank you! It’s truly shocking how she’s able to get away with this. Then HR excuses her behavior so they are a problem too. I don’t take the job too serious but being in a abusive situation was not part of the job description.

Have to remember HR's real job is to cover the company's ass

Bro why the f*** would you still be working there? F*** that. Go someone else where they’d treat you with respect.

She has done stuff to other employees but they won’t speak out against her. My next step is going to the news station and leaving a google review so everyone knows

I reported the injuries on the same day. I’m actually at the doctors office now for a follow up. Each week I have to come to the doctors office to get them to extend my work limitations.

The Target store won’t even help me with workman’s comp

What state are you in? I can help with workers compensation

I only adjust in a few states but I have access to a lot of resources across all 50 and could try to at least offer some advice as someone who works in the industry

Retaliation alone is grounds for them to fire her

Would that be a personal injury attorney or employment attorney? I just don’t know which attorney to actually contact.

Exactly! Which is why I’m trying to handle the situation right but idk how. Tomorrow I’m going to call a workman’s comp attorney and see what they say

I wish you luck. Sounds like s***ty situation but it seems like you have enough evidence and claims to back everything up which helps.

Hope you come out on top!

Yeah I don’t adjust there but can get some info for you tomorrow when I’m at work

It sounds like most of your issues (and where you’re gonna get a bigger check from, at least based on what you’ve said here) will be more in the realm of employment law, but if you’ve been going to the doctor and what not and the doctors notes state it’s work related then you’ll have a claim on the workers comp end of things too

Most WC lawyers are extremely cheap or only take payment from whatever settlement/impairment rating you may be owed

I’ll check on some stuff tomorrow and get back at you. If you have Twitter DM me your handle so I can answer more specific stuff there

Definitely talk to a lawyer. If you’re trying to build a case you don’t want to talk about it too much on the open internet

    Try and get CONCRETE proof
like when you talked to HR, make sure its in writing
Show how you were scheduled even after (screenshots of your scheduling app)
Try and get a video somehow of her assaulting you

The only thing I did was submit a report to target via the integrity hotline on the following shift. So it’s documented in their systems.
