So I’m a target inbound (I unload thousands of boxes from trucks) worker and there’s a crazy manger named Erica who has decided to be a nuisance to me. She has
• hit me with a railing, which injured my arm and caused me to lift with my chest. Consequently, I have permanent chest pain. It feels like my chest is being pulled apart.
• thrown my work on the floor. After I reported her to HR, she walked up to me and threw all of my work on the floor and walked away.
• hit me with boxes. For example she’ll be grabbing a large box near me and allow the box to brush against my arm. She knows im in a close vicinity to her and doesn’t care.
• told me to “move” out her way.
• falsely accused me of not calling out properly (despite my phone records proving otherwise).
• After I rerouted her for abuse, Target still made me work closely with her which enabled her to retaliate.
• I also have a pre-existing medical condition that was injured due from her attacks.
I reported her to HR but they told me that she hasn’t done anything to warrant a response. I have dates, times, and incident reports of all her actions. Additionally, for the last two weeks I’ve been working with work restrictions but I am still in pain. People keep telling me I have a strong case to sue but I don’t know how. I have called employment attorneys and personal injury attorneys and they haven’t been any help.
Do I have a case? Because I am hitting a dead end. I have been calling attorneys for the last two weeks and I’m starting to give up.
You can sue for anything. Doesn't mean you'll win. File a complain with your states labor board and start documenting anything that happens in a journal with timed and dated noted.
Alternatively, get a new job because this one sucks

1. Record her behaviour. Not easy and kinda risky, but if you show that to hr, they might actually do something. Or even better: Go online about it. Tweet at target. Show this a news outlet or something. Maybe it well get the necessary attention.
2. Post this on reddit. Reddit sucks ass most of the time, but there are people who know more about these things than ktt. Find a specific subreddit, one about work, lawyer advise etc. and u might be able to find what u need.

This. Your calls and complaints to HR should have been documented, but call and make sure they were just so you know. I would try and provoke her to lash out on me again and record my conversations with HR to show their inaction. Just have some hard evidence to show you're being mistreated and your company isn't doing anything about it.
HR viewed the hitting video and claimed she “didn’t see me” and never followed up with her throwing my work on the floor. So there’s at least one incident they ignored.I’m not sure if I can get the video tho
see if you can go that far back in the cameras and record it with a phone or something, or try to provoke her to do it again and be recording her when she does it or go back to surveillance and record her doing it. I'd try to get a capture of her doing it two or maybe three times and a recording of HR choosing to not do anything about it, just to have absolute proof it isn't a one time thing. Try to get recordings of her mistreating your other peers too. The reason they aren't doing anything is because she has seniority in the company and her experience is more valuable than yours, in their eyes. You are more replaceable than she is to them.

This happened to me at 17 and I actually waited for the dude to clock out and punched him in the face and they swept that under the rug too

This case in particular i wouldn’t be surprised if OP could get a decent lawyer bc these are serious accusations that target would def throw OP a check worth OP’s yearly earnings tenfold to shut him up
