Dec 12, 2022A couple of thoughts…she actually really does need to take the stand…in domestic violence / sexual assault cases etc., the case can be a lot weaker without the victim’s testimony. It kinda sucks for the victim in a lot of cases bc then they’re put on trial during cross examination.
This can open up a can of worms especially in a high profile case where the victim has given public interviews and made public claims about things surrounding the defendant and the incident. It will be up to the judge to permit or deny certain lines of questioning. Some things may prejudice the jury that are being referenced in the thread. Wouldn’t be surprised if the judge limits questioning and I bet this will be a motion and back and forth between DA and defendant team about what questions are relevant and not until judge rules.
