if they are asking for clarification of "willfully" (or "willingly") and "on purpose") regarding the assault charge, then this is the element they're focused on (quoted from 2022 cali jury instructions):

1. The defendant did an act with (a deadly weapon other than a
firearm/a firearm/a semiautomatic firearm/a machine gun/an
assault weapon/a .50 BMG rifle) that by its nature would directly
and probably result in the application of force to a person

2. The defendant did that act willfully;

3. When the defendant acted, (he/she) was aware of facts that would lead a reasonable person to realize that (his/her) act by its nature would directly and probably result in the application of force to someone;
AND
4. When the defendant acted, (he/she) had the present ability to
apply force (likely to produce great bodily injury/with a deadly
weapon other than a firearm/with a firearm/with a semiautomatic
firearm/with a machine gun/with an assault weapon/with a .50
BMG rifle) to a person,"

The jury instructions go on to say: "Someone commits an act willfully when he or she does it willingly or on purpose. It is not required that he or she intend to break the law, hurt someone else, or gain any advantage." (as in, if Tory meant to shoot the gun, even if just to scare Megan/shoot at her feet like the bad guy in a Western movie, if he intentionally discharged the gun, he's liable for what happened next)

Idk, to me, this would imply they do think Tory is the shooter and just want to see if the second element is met (maybe they think it was an unintentional discharge, in which case the second element might not be met. or they think willingly/on purpose meant he had to intend to actually shoot Megan's feet, which it doesn't)
