well there's a difference between viewing a state or authority as "legitimate" and viewing a state or authority as representative. popular support isn't necessarily needed for the affirmation of something existing whether or not you believe yourself to be part of that in-group/out-group or not.

even the most out of their mind esoteric neonazis or the most obtuse anarchists still recognize the US as a state power they live under. even people who say stuff like "not my president" or something still are ultimately acknowledging a state conceptually even if they attempt (barely lol) to reject those in power; similarly, those who seek to undermine a state still ultimately recognize the state exists hence why they wish to undermine it (or destroy it). It's not too dismilar from how people hate police or other authorities are likely going to listen to them anyway if they're pulled over or being served something - there's more to it than the show of force or fact that the officer has a gun or whatever. It's a wider social acknowledgement of role which captures a population wider and more influential than just an individual

i'm not sure if i'd say it's "popular consent" that determines a state as much as it is social conditioning. while en-masse, to some degree, yes, there is an abstract "consent", it's not really a "decision" of "consent/non-consent" as much as a latent acceptance of an assumed structure
