I think what you’re trying to say is that she was inebriated to the point that she wasn’t even aware of what was happening. The rapist took advantage of that, and proceeded to do what he did. She was so out of it that she might not have been able to display that she didn’t want him all up on her.

So to the average person just getting on the train, and you see them 2, it might’ve just looked like 2 people getting freaky on the train, which is not at all unheard of in a major city. I think you’re trying to rationalize why nobody would otherwise step in and stop the rapist.

My position was this: inaction is bad, but its also normal human behavior in Philly, and normal people exhibiting normal human behavior does not call for moral outrage or criminal punishment. People responded by saying stuff like "but how could you ignore 40 minutes of screams for help" which prompted my response. "no it wasn't 40 minutes of screams for help". How do I know this? The woman blacked out and was too drunk to resist, that is why I doubt it was 40 minutes of screams for help.
