I don't think you understand quite what the supreme court does, but anyways, any hope for a revolutionary alternative to justice will not be won in the courts or at a ballot box, and thus its existence will not be dependent on those institutions giving it legitimacy.

The idea that it should only be applied to certain types of crimes, basically doing the bare minimum, shows to me just how ingrained the idea of incarcerating people is into the minds of people.
