yeah laws need to be updated, it’s not fair. I understand the sampled artist should be credited and compensated, but there needs to be limits to how much of the cut they can sue for. Or maybe there needs to be a regular compensation request process through labels that allows the original artist to get that money without completely f***ing over the other artist.

Whatever it is, it’s not fair that a small artist can make a great song, try to reach out to the original artist, get no response, then when the song blows up they’re sued for 90% of the earnings. There’s gotta be limits

How does it being the foundation of hip hop mean it is not stealing? lmao. Where is the logic here?

Although I would argue that making an entire beat from scratch does take more talent than sampling no matter how any1 might try to argue otherwise.

I'd wager that all of the most respected producers are able to make a beat from scratch

I mean, It is still stealing. Just because things were different in the 80s that dosent apply to right now. Just because it wasn’t respected then doesn’t mean anything right now. Would you care if you made a song and it got sampled and you got no type of credit for it?

Hot take: sampling isn’t even close to as impressive as original production. In fact, I believe the overzealous defense of sampling has spawned laziness in production. More than half of your favorite beats nowadays feature Splice loops and I can almost guarantee they do if they have a flute or guitar involved. It’s leveled the playing field and allowed for “producers” without a creative bone in their body to toss some drums under a loop and call it a day.

Dilla-esque s*** is forever cool though.

    Using loops is not sampling

Kanye only gets sh!t on because he uses samples we recognize.... other producers like Dr Dre who use obscure sounds get away with it bc we think it’s from scratch & often times not even vocals. just the instrumentation. But yeah hip hop is fundamentally built from sampling

Honestly yall pay too much attention to the legal side of things, sampling is a beautiful musical act, it's breathing new life into a composition and making it yours, creativity has no boundaries

By “no type of credit for it?” do you mean not even getting paid if the beat gets used by a label?

If so, then yes because that is literally stealing. But if an artist samples an old song of mine and makes a dope song out of it, I get a cut of the backend and a writing or add. production credit, but no verbal credit or feature I would not give a f***. That’s how it’s supposed to work in the industry, and it’s the labels job to do that

My favorite parts of songs are always samples if it has one. I kind of feel disappointed at first cause I first think "this guy is a f***ing genius for this" then I discover it's a sample and that kind of tones down my reaction but I still very much appreciate the use in the end.

    Using loops is not sampling

It’s sampling without the charm of sampling

It’s pretty much sampling but without other producers throwing their bussy at you

All depends on what you value more, making cool music and collaboration, or having other producers want to suck you off
